Terms of Service

1. Acceptance of terms
Garagio (the "Service") is operated by Garagio LLC, a Connecticut limited liability company ("Garagio," "we," "us," "our"). By accessing or using the Service, you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service. If you're using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Eligibility
To use Garagio, you must:
- Be at least 18 years old.
- Have the legal capacity to enter into a binding agreement.
- Not be barred from using the Service under applicable law.
During Vbeta, access is invite-only. Invite codes are non-transferable.
3. Account responsibilities
You are responsible for:
- Maintaining the security of your email account, since Garagio uses passwordless magic link authentication. Anyone with access to your email can sign in as you.
- All activity that occurs under your account.
- Providing accurate and current information at signup, including your real first and last name (required for ownership verification).
- Notifying us promptly of unauthorized access at help@garagio.co.
4. Acceptable use
You agree NOT to:
- Claim ownership of vehicles you do not own.Garagio's value depends on accurate provenance. Misrepresenting ownership undermines the platform and may result in account termination and reporting to relevant authorities where appropriate.
- Upload content that is illegal, infringing, defamatory, obscene, or harmful.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Use the Service to harass, threaten, defame, or harm others.
- Attempt to access accounts, data, or systems that are not yours.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Use automated systems (bots, scrapers, etc.) to access the Service without our express written permission.
- Resell, rent, or commercially exploit the Service without our written consent.
- Use the Service to commit fraud or violate applicable laws.
5. User content
Your ownership
You retain ownership of everything you upload to Garagio: photos, documents, vehicle information, timeline entries, profile content. You own your data.
License you grant Garagio
By uploading content to the Service, you grant Garagio a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify (for the purpose of generating thumbnails, optimized renditions, and similar derivative formats), and process that content solely for the purpose of operating the Service and providing it to you. This license terminates when you delete the content or your account, subject to backup retention periods described in our Privacy Policy.
Aggregated and anonymized data
You further grant Garagio the right to use aggregated, anonymized data derived from your content for research, product improvement, and to share or sell to third parties (such as dealers, manufacturers, or market researchers). Such aggregated data will not identify you personally.
Public content
If you make your Garage Passport public, the content you have designated as publicly visible may be accessed, viewed, screenshotted, and shared by others. You are responsible for what you choose to make public. Garagio is not responsible for the misuse of publicly shared content by third parties.
Content you do not own
Do not upload content that infringes anyone else's intellectual property, privacy, publicity, or other rights.
6. Verification of ownership
Garagio includes (or will include in V1) a verification system to confirm ownership of vehicles. By using the Service, you authorize Garagio to compare information in your account (such as your name) to documents you upload to your Vault (such as registration, insurance, or title) for the purpose of verification.
False claims of vehicle ownership may result in:
- Removal of the falsely claimed vehicle from your Garagio.
- Suspension or termination of your account.
- Reporting to relevant authorities where appropriate (e.g., if the false claim constitutes fraud).
7. Beta service disclaimer
Garagio is currently in Beta. This means:
- Features may change, be added, modified, or removed without notice.
- Data loss, while unlikely, is possible. We recommend keeping local backups of important documents you upload.
- Service availability is not guaranteed. Garagio may go offline temporarily for maintenance or longer for technical reasons.
- We are actively iterating based on feedback. Your experience will evolve.
By participating in Beta, you accept the risks of using an early-stage product.
8. Intellectual property
The Service, including its design, code, branding, copy, name "Garagio," and content (other than your User Content), is owned by Garagio or its licensors. You may not copy, modify, distribute, perform, display, sell, or create derivative works of the Service or its content without our written permission.
Marque logos and brand marks displayed in the Service are used under nominative fair use to identify user-owned vehicles. Garagio does not claim ownership of, sponsorship by, or endorsement from the brands they represent.
9. Third-party services
The Service may include integrations with third-party services, including but not limited to the U.S. National Highway Traffic Safety Administration (NHTSA) vPIC VIN decoder API. Garagio is not responsible for the accuracy, availability, or content of third-party services.
10. Termination
We may suspend or terminate your account at any time if:
- You violate these Terms.
- You engage in fraudulent, abusive, or harmful activity.
- Required by law.
- We discontinue the Service.
You may terminate your account at any time via Account Settings. Soft-delete and permanent deletion timelines are described in our Privacy Policy.
11. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or quiet enjoyment.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We do not warrant the accuracy of:
- Vehicle information returned by VIN decoders or other data sources.
- Market data, valuations, or estimates.
- Verification results.
- Any user-generated content on the Service.
12. Limitation of liability
To the maximum extent permitted by law, Garagio and its affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, business interruption, or loss of goodwill, arising out of or related to your use of the Service.
Our total cumulative liability for any claim arising from or related to the Service is limited to the greater of: (a) the amount you have paid Garagio in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100). During the Beta period and free tiers, where no payment has been made, our liability is limited to one hundred dollars.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Garagio and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your violation of these Terms.
- Your User Content.
- Your violation of any law or third-party rights (including intellectual property and privacy rights).
- False claims of vehicle ownership.
14. Governing law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Fairfield County, Connecticut, and you consent to the exclusive jurisdiction of those courts.
15. Changes to these terms
We may update these Terms. Material changes will be communicated via email or a prominent notice in the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Garagio regarding the Service and supersede any prior agreements.
